General Terms and Conditions of Sale

General Terms and Conditions (GTC) for purchases made online at www.alexanderjohn.it

 

The Company IODICE ALESSANDRO based in Viale 4 Aprile, 13 80144 – Napoli invites users to read these General Terms and Conditions of Sale (“CGV“) that govern the purchase of products and the management of orders placed on the site.

Products from different brands are offered for sale at www.alexanderjohn.it.

1.Conclusion of contract and delivery of products

 

  • 1.1 Every order placed on www.alexanderjohn.it implies the conclusion of a contract of purchase and sale in the Italian language.
  • 1.2 By clicking on the “Buy” button, the customer places a binding order with respect to the items contained in the virtual shopping cart. Once the order is transmitted, Alexander John property of the company IODICE ALESSANDRO will send within 1 hour to the customer an e-mail confirming the order. The contract of sale is concluded between Alexander John property of the company IODICE ALESSANDRO and the customer when the latter receives the confirmation of the order. If the customer does not receive any confirmation of the order within the period indicated in this art. 1.2., the relevant order shall be deemed to be rejected by Alexander John property of the company IODICE ALESSANDRO and, therefore, devoid of effect. Orders in relation to which the customer has opted for advance payment will be shipped as soon as Alexander John property of the company IODICE ALESSANDRO receives full payment of the purchase price and any shipping costs. Alexander John invites, for-therefore, the customer to pay the price as soon as they receive the order confirmation and in any case within the next 48 hours.
  • 1.3 The purchaser gives his or her prior consent to the assignment to third parties, in particular to the company IODICE ALESSANDRO, of claims for payment of the purchase price.
  • 1.4 Where the products that are the subject of the order are not available for causes beyond the conduct of Alexander John owned by the company IODICE ALESSANDRO, the latter shall promptly notify the customer. In this case, there will be no obligation for Alexander John to deliver the goods ordered, except where Alexander John has assumed the risk of supply in relation to the products that form the order in question.In any case, if the products ordered are not available Alexander John will refund, within 48/72 hours, in favor of the customer, any amount already paid, if any.
  • 1.5 Alexander John property of the company IODICE ALESSANDRO does not take responsibility for having to search for and source unavailable products from other sources. This provision also applies to orders for fungible goods (for which only the type and characteristics of the products are described). Alexander John is only obligated to deliver what is in stock and what is ordered from its suppliers. Alexander John delivers to the Italian territory only and the rest of the world with the exclusion of some countries given the fault of our shipping partners who do not ship to those countries. If the delivery time is expressed in working days, all days between Monday and Friday inclusive are considered as such.

2.Prices, shipping charges and express delivery

  • 2.1 The customer is obliged to pay the price published on the product page when placing the order. The price quoted is final and includes VAT.
  • 2.2 Shipping charges are the responsibility of Alexander John on most products except for a few that have a shipping charge listed on the product page. In the event that the Customer returns products in accordance with the procedure set forth in these conditions and applicable regulations, shipping costs will not be refunded.

3.Payment

  • 3.1 Alexander John accepts a variety of payment methods including but not limited to: by bank transfer , Paypal and cash on delivery with a surcharge on the total price on the shopping cart page of 5% . Alexander John reserves the right to refuse certain payment methods and to require different payment methods for certain orders. Note that Alexander John only accepts payments from checking accounts and that the client is responsible for any costs associated with the transaction.
  • 3.2 In the case of a purchase made with a credit card, the charge is made at the time of the order placed at www.alexanderjohn.it.
  • 3.3 The buyer agrees to receive invoices and credits in electronic format only.

4.Use of promotional vouchers

  • 4.1 Promotional coupons cannot be purchased, are offered by Alexander John as part of promotional campaigns, and can be used for a limited period of validity.
  • 4.2 Promotional vouchers can only be used once in connection with a single order within the specified validity period. The possibility of using promotional vouchers may be excluded for the purchase of some products. Promotional coupons cannot be used to purchase gift certificates. It is possible that the use of a promotional voucher may be subject to a minimum spending amount.
  • 4.3 The value of the products purchased must be equal to or greater than the value of the promotional voucher. If the amount of the promotional voucher is not sufficient to cover the value of the products ordered, the difference can be paid by any of the accepted methods of payment mentioned in Article 3 above. Promotional vouchers are not redeemable for cash and no interest accrues on the credit they represent. Promotional vouchers will not be refunded if the purchaser decides to return part or all of the products ordered.
  • 4.4 Promotional vouchers can only be used if the order is finalized, cannot be used retroactively, and cannot be transferred to third parties. Unless otherwise provided by Alexander John, several promotional vouchers cannot be combined for the same order.
  • 4.5 If during the course of the order the customer should have used a promotional voucher, and if the total value of the order – due to the customer’s withdrawal – should be less than the value of the promotional voucher, Alexander John reserves as of now the right to invoice the original price of the goods remaining in the customer’s possession.
  1. 14-day right of withdrawal

The customer has the right to withdraw from any order by providing a reason and by any statement, as long as it is explicit, delivered to Alexander John. However, the right of withdrawal is excluded relatively sealed that are not suitable for return for hygienic or health protection-related reasons and have been opened after delivery, such as, but not limited to, cosmetic products for body care and beauty.

If the customer intends to return the purchased products, he/she can use the email address info@alexanderjohn.it writing all the information (first name, last name, city, zip code, product title, purchase size, day of order, order id).

6. Information regarding the right of withdrawal (ex art. 49, paragraph 1, letter (h) of Leg. n. 206/2005 “Consumer Code”)

The customer has the right to withdraw from the contract, giving reasons, within 14 days. The withdrawal period expires after 14 days from the day the customer or a third party, other than the carrier and designated by the customer, acquires physical possession of the last item ordered. In the case of a contract for multiple goods ordered by the customer in one order and delivered separately, the 14-day period begins on the day the customer or a third party other than the carrier designated by the customer acquires physical possession of the last good.

To exercise the right of withdrawal, you must inform Alexander John at info@alexanderjohn.it of your decision to withdraw from this contract by any explicit statement to that effect (e.g., by a letter sent by e-mail).

The time limit set for withdrawal is deemed to be met if the customer transmits his statement before the expiration of the 14-day period from the day on which the customer or a third party, other than the carrier and designated by the customer, acquires physical possession of the last good ordered. In the case of a contract for multiple goods ordered by the customer in one order and delivered separately, the 14-day period begins on the day the customer or a third party other than the carrier designated by the customer acquires physical possession of the last good.

  • 6.1 Effects of withdrawal
  • Following withdrawal from this contract, Alexander John property of IODICE ALESSANDRO shall refund all payments made by the purchaser, including delivery costs, without undue delay and in any case no later than 14 days from the day Alexander John is informed by the customer of the decision to exercise the right of withdrawal. Such refunds will be made using the same payment instrument used by the customer at the time of purchase, unless otherwise stipulated.Where the purchaser has chosen, as the method of payment at the time of purchase, cash on delivery, he must indicate, as part of the online withdrawal form, the bank account to which he intends to receive the credit of the price. In case of failure to provide bank details or in case of providing wrong bank details, Alexander John will automatically credit the amount of the price to the customer’s account who can use it for subsequent purchases or request its subsequent return by notifying Alexander John via email info@alexanderjohn.it their bank details by responding to the email that Alexander John will send to notify them that the account has been credited.In any case, the customer will not incur any costs as a consequence of such a refund. Refunds may be suspended until receipt by Alexander John of the returned products or until the customer demonstrates that such goods have been shipped, whichever is earlier.The customer shall return or deliver the products without undue delay and in any case within 14 days from the day on which he communicated his willingness to withdraw from the purchase and sale contract.The Products shall be returned

– properly packaged in their original packaging, not spoiled, damaged or soiled and equipped with all accessories, instructions for use and documentation, if any. In case of loss of the original packaging, the Customer shall, at its own care and expense, arrange for its replacement in order to proceed with the return of the Products to Alexander John;

– equipped with the shipping document (which will come at the customer’s expense if they have no shipping partner) so that Alexander John can identify the customer;

– without manifest signs of use, other than those consistent with carrying out a normal test of the article (they should bear no trace of prolonged use or otherwise exceeding the time required for a test and should not be in such a state as to prevent resale).

If the returned product does not comply with the requirements of the preceding paragraph, or the exception to the right of withdrawal indicated in paragraph 6 in relation to sealed products operates, the withdrawal will not be effective.

The cost of returning the goods is borne by the customer in the amount of 7.5€, which will be deducted at the time of the refund. The customer is responsible for any decrease in the value of the goods resulting from handling the goods other than what is necessary to establish the nature, characteristics and operation of the goods.

  • 6.3 Standard withdrawal form

The customer who wishes to withdraw from the contract using the return form by going to the“return form” page is requested to fill it out and send it via the form on the page, alternatively to using the standard form above the customer can use the following text to the following email info@alexanderjohn.it:

I/We (first and last name) hereby notify you of my/our (order number) withdrawal from my/our (order number) concluded contract for the purchase of the following goods/services (product title) – ordered on (day of purchase) / received on (day of package delivery) – name of purchaser(s) – address of purchaser(s) – date – [da inserire in caso di pagamento avvenuto in contanti alla consegna] IBAN code to be credited.

7.Possibility of return up to 14 days after receipt of products

  • 7.1 Without prejudice to any statutory right of withdrawal, Alexander John offers the option of returning purchased products up to 14 days after receipt of the products. This option allows the customer, after the 14-day period for withdrawal has expired (see “Information regarding the right of withdrawal” above), to dissolve the contract by returning the ordered products to Alexander John within 14 days of receipt of the products.
  • 7.2 To return Alexander John products, the customer can use the email address info@alexanderjohn.it or can access via the page shown below or on the specific “Return Form” page.
  • 7.3 The deadline is deemed to be met if the customer ships the goods before the expiration of the 14-day period. However, the extended return option can only be used if the customer has tested/tested the products in the same manner and with the same care as he/she would have used in a physical store with the understanding that this option is therefore excluded for products that are not suitable to be returned for hygienic or health protection-related reasons and that have been opened after delivery, such as, but not limited to, cosmetic products for body care and beauty; in addition, the products must be returned in their original condition, intact, free of damage and in their original packaging. If the original package is lost, the Customer shall replace it at its own care and expense. In any case, in the short period of 14 days from the receipt of products, the provisions of Leg. 206/2005 (Consumer Code) on the subject of withdrawal. The ability to return products does not in any way limit the legal warranty that is owed to the customer without reservation. The ability to return products does not apply to orders placed through a gift card.

8.Refunds

  • 8.1 Refunds are credited directly to the account or payment instrument used at the time of purchase. For payments made by bank transfer, reimbursement will be made to the account used for payment. For payments made through Paypal or credit card, the refund will be made to the Paypal account or credit card. For payments made by cash on delivery, reimbursement will be made, alternatively, to the bank account that the customer will indicate by filling out the standard withdrawal form or in the notice he or she will send to Alexander John to communicate the withdrawal. It is understood that in the event that the customer does not indicate a bank account for crediting when exercising the right of withdrawal or indicates an incorrect bank account, Alexander John will automatically proceed to credit the customer’s account in order for him to use this amount for subsequent purchases or request a subsequent return by notifying Alexander John of his bank details by responding to the email with which Alexander John will notify him of the crediting of the amount to the account.
  • Invoices will be issued in electronic format only.

10.Warranty for defects and deformities of products and additional information

  • 10.1 Purchases made on Alexander John are subject to the rules of the Consumer Code regarding warranty for defects and deformities of products. Therefore, the customer will be granted the rights set forth in Art. 130 of the Consumer Code, and these rights must be exercised within the terms set forth in Art. 132 of the same Consumer Code.
  • 10.2 These GTC can be viewed at www.alexanderjohn.it and can be saved using the relevant browser command (usually, File -> Save As).
  • 10.3 You can store the order details and download the GTC by using the relevant browser command to save the order summary that appears on the last screen of the purchase process, i.e., by waiting to receive the automatic order confirmation message that Alexander John sends by email following the completion of the order. This confirmation message includes the details of the order, and can easily be printed or saved through the functions provided by e-mail programs.

11.Applicable law

  • 11.1 These GTC and the contracts of purchase and sale are governed by Italian law (and in particular by the Consumer Code – which in Articles 46 to 67 regulates distance contracts – and by Legislative Decree 70 of 09/04/2003 on electronic commerce) and must be interpreted in light of this.
  • 11.2 For any disputes that may arise in connection with the GTC and/or the Sale and Purchase Agreements, customers may activate an out-of-court dispute resolution procedure that complies with the requirements of Articles 141 et seq. of the Consumer Code. In the event that the Client activates the above procedure Alexander John guarantees its participation in an attempt at amicable settlement.
  • 11.3 The Customer also has the right to use the online dispute resolution procedure available at http://ec.europa.eu/consumers/odr/

12. Email recenesions

  • 12.1 We use your information to send reminders for reviews of products purchased on alexanderjohn.co.uk
  • 12.2 All data will not be disclosed or sold/sent to other entities outside alexanderjohn.co.uk
  • 12.3 After customers leave their reviews, they will be rewarded with a discount code that can be used for their next purchase within 60 days from the date of receipt.
